Globex Court Action

Court Finalises Action against Globex

The Federal Court at Adelaide has made orders, against Globex Systems Pty Ltd, its directors and two former employees for contraventions of the Trade Practices Act.  This followed more than 70 complaints and inquiries to the ACCC about the company which supplies printer and photocopier cartridges by direct telephone marketing.

It was alleged that the company had represented that businesses and primary schools in South Australia, Victoria, New South Wales and Queensland had agreed to buy Globex cleaning products or cartridges. It was also alleged the company represented that the cartridges were new and not refilled and that it had a right to payment for unsolicited goods.

The following is an example of the conduct engaged in by Globex:

In September 2002 during a direct marketing telephone conversation between a representative of Globex and the office administrator of a regional South Australia primary school, the administrator agreed to buy two toner cartridges from Globex. No other agreement to purchase was made.
